Exclusion from the contest
Thomann customers who have purchased one of the Do-It-Yourself kits listed below (hereinafter “kit”) from us, Thomann GmbH (www.thomann.de), and who have reached the age of 18, are eligible to participate. Minors who have not yet reached the age of 18 are excluded from participation. Prizes will not be awarded to minors whose participation is excluded.
Our employees, as well as Thomann’s parent or subsidiary companies and agencies, contractors and their agencies and other persons directly involved in the design and implementation of this campaign, as well as family members and household members of all persons listed above, are ineligible to participate.
By participating in the campaign, the participant declares her/his consent to these conditions of participation.

Kits are only eligible for entry while stocks last. We do not guarantee that all kits will still be available during the promotion period (see Participation section).
Duration of the competition and procedure
The contest starts on April 18, 2022 at 10:00 am (CET) and ends on June 19, 2022 at 11:59 pm (CEST). To participate in the competition, the following conditions must be met:
– Have a Thomann customer account
– Own a Thomann DIY kit for the construction of the instrument (new acquisition not necessary; customers who already have a Thomann DIY kit can of course also use it)
– Design and construction of an instrument with the corresponding Thomann kit for the duration of the competition (please do not send already designed and pre-made instruments!)
– Share a video of the DIY instrument you designed yourself on Facebook, Instagram, TikTok or YouTube via your own profile or channel during the contest period (the date of posting is decisive); Images of the assembly and finished instrument can also be submitted.
– The sharing must be public.
– The video must show that the DIY instrument can be played (see jury decision criteria in Implementation and processing section)
– In order for us to find the videos, posts must be tagged with the hashtag #DiyKitChallenge22. On YouTube, #DiyKitChallenge22 should also be included in the title of the video.

For the duration of the contest, we search for entrants’ videos that meet the above requirements through our social media pages using the hashtag and save them to our IT systems if they meet the above conditions and are therefore suitable to pass in front of our jury (see section Implementation and processing). These stations then participate in the jury’s decision.
In the event of a dispute regarding participation, the legitimate owner of the social network profile that was used to post the photos or videos concerned is registered as a participant. The “rightful owner” is the natural person who is to be considered the owner of the profile according to the terms of use of the respective social media provider, in particular whose profile has been verified on an e-mail address belonging to her/him. Potential winners may be required to provide us with proof that they are the rightful owner of the account in question or risk losing their right to the prize.
The participant is responsible for the accuracy of her/his data, in particular her/his e-mail and / or postal address. Entries with invalid/incomplete data, e.g. non-functional or inactive email addresses or fake profiles on the respective social networks will be disqualified.
Each participant bears the costs of purchase, construction of the kit, in particular the working time and the costs for any additional material necessary.
Implementation and treatment
On June 20, three (3) winners will be selected by decision of the jury from among all eligible participants from the period mentioned in the Duration of the competition and conditions of participation section. In order to be able to participate in the jury’s decision, the photos or videos must have been posted online within the time limit. The selection by decision of the jury is based in particular on the following criteria:
– DIY instrument playability
– Quality and cleanliness of the manufacture of the DIY instrument
– Special fabrication (e.g. special visual designs, decorations and finishing)
– Originality
– Overall visual impression
The jury consists of five (5) competent Thomann employees from the corresponding Thomann music departments.
The winners will be informed by us by message via the social network used for the publication by the participant. The winner must respond to the notification within the specified time and provide us with their name, email address and postal address so that we can identify them as a Thomann customer and credit the voucher prize to their customer account; otherwise, the right to the price is lost. In this case, we reserve the right to designate a new winner by means of another jury decision or to designate the following participants from the first jury decision as winners.
The prizes, gift certificates, are non-exchangeable, non-transferable, cash payment is not possible and no other prize can be selected as a replacement.
If
(a) a winnings notification cannot be received,
(b) the winner rejects the prize, or
(c) the voucher cannot be credited to the winner’s customer account and this for reasons for which we are not responsible,
that winner will be disqualified. In this case, we reserve the right to designate a new winner by means of another jury decision or to designate the following participants from the first jury decision as winners.
Price description
Three (3) vouchers will be awarded as prizes to three (3) winners with a merchandise value of €500, €350 or €200 from Thomann GmbH. 1st place receives the voucher with the highest value, 3rd place the voucher with the lowest value. The prize is awarded by crediting the value of the voucher to the participant’s Thomann customer account.
Terms and conditions
We reserve the right, at our own discretion, to end the competition at any time without notice. We have this option in particular if, for technical or legal reasons, the correct implementation of the campaign cannot be guaranteed. In this case, we reserve the right to award the prizes among the eligible participants identified until the moment of cancellation by decision of the jury.
We also reserve the right to exclude persons from participation at our own discretion:
a) in the event of manipulation related to the access or the implementation of the action,
(b) in the event of a breach of these Terms of Participation,
(c) for unfair conduct or
(d) in the event of false or misleading information in connection with participation in this competition.
An attempt by a person to prevent the lawful course of action, e.g. Interfering with, for example, technical aids may be a violation of criminal or civil laws. If such an attempt is made by any person, we reserve the right to take legal action to claim damages, as well as withdraw and recover winnings. Failure to enforce any provision contained in these Official Terms of Participation shall not constitute a waiver by us of compliance with such provision.
Privacy Policy
If the participant participates in the campaign or if her/his publication is taken into account for the decision of the jury, her/his profile name on the relevant social network profile and, in the event of a win, her/his e-mail address, name and address, will be processed by us to process the campaign. The legal basis for the processing is the performance of the contract or the initiation of a contractual relationship with the participant which arises in the event of victory, Article 6, paragraph 1, letter b of the GDPR.
We have partially transferred the services necessary for the implementation and processing of the campaign to third parties (“cooperation partners”). Participant data is stored by the cooperation partner(s) solely for the purpose of carrying out and processing the campaign for the duration of the campaign. All data will be deleted after the campaign has been completed and processed.
We are committed to protecting the privacy of participants and ensure that data will be processed in accordance with the Federal Data Protection Act, the Telemedia Act and the General Data Protection Regulation (GDPR). In particular, we refer in this context to our data protection information. Further information on the exercise of data subject rights to which the participant is entitled can also be found here.
Responsibility
We are released from all obligations with the fulfillment or delivery of the prize to the participant, provided that, depending on the type of action, we have a legally binding obligation towards the participant.
We are liable in the event of malice, intent or gross negligence in accordance with the legal provisions. Damage caused by us by simple negligence will only be compensated if it is a breach of an essential obligation, the non-fulfillment of which jeopardizes the achievement of the object of the contract and / or the fulfillment of which the proper execution of the action and compliance on which the Participants can regularly rely (cardinal obligation).
We assume no liability for the bankruptcy of a cooperation partner or the consequences thereof for the implementation and processing of the campaign. The resolutions by us on all matters relating to the respective action are final and binding. We reserve the right to correct typographical or mechanical errors.
It also assumes no responsibility for lost, damaged, illegible, incomplete or late entries, whether due to transportation delays or incomplete due to system errors. Furthermore, we assume no responsibility for registrations not received or incomplete due to circumstances of force majeure, such as traffic jams, unauthorized third-party interventions, malfunctions of computer or telecommunications systems or incorrect registration or failed incoming data transmissions. Proof of transmission does not count as proof of receipt by us. Winner is responsible for all applicable taxes, duties and fees not set forth in these terms and conditions.
Various
The law of the Federal Republic of Germany. In the event that the participant is a consumer, this only applies insofar as the protection granted by the mandatory provisions of the law of the state in which the consumer has her/his habitual residence is not withdrawn. If individual provisions of these Conditions of Participation are or become invalid, this shall not affect the validity of the remaining Conditions of Participation.
