1. Organizer
The “Customer Stories” campaign (hereinafter “Campaign”) is organised by
Thomann GmbH (hereinafter “Organizer”), Hans-Thomann-Straße 1, 96138 Burgebrach, Germany.
2. Campaign Period
The Campaign begins on the date of publication of the call for entries. Customer Stories submitted and any resulting footage, interviews, recordings, or other Campaign Content may be used by the Organizer as part of an always-on marketing initiative without any time limitation, subject to the terms set out in these Conditions.
3. Eligibility
3.1 Participation is open worldwide to individuals who are natural persons and have reached the age of majority (18 years) at the time of entry.
3.2 Employees of the Organizer, its subsidiaries, affiliates, agents, or any other parties involved in the implementation of the Campaign are not eligible to participate.
4. How to Enter
4.1 To enter, participants must submit a story that relates to music, involving Thomann products or the role of music in the entrant’s life, via the official online submission form or as otherwise instructed in the Campaign call-to-action.
4.2 Submissions must include the participant’s full name, contact details, a description of the story, and may optionally include photographs and/or a short video introducing the participant and their story (“Entry”).
4.3 Only one Entry per person is permitted unless otherwise stated in the Campaign announcement.
5. Selection of Participants & Prizes
5.1 From all eligible Entries, the Organizer will select a limited number of participants (“Selected Participants”) at the Organizer’s sole discretion, based on the quality and relevance of the story, creativity, uniqueness, and suitability for interview and filming.
5.2 All Selected Participants will be individually contacted by the Organizer.
5.3 Participation prize:
(a) Twenty (20) participants will be randomly drawn from all valid Entries and awarded a €50 Thomann voucher (“Participation Voucher”).
(b) Each Selected Participant may receive a €1,000 Thomann voucher (“Interview Voucher”), subject to separate notification and conditional upon:
- the successful completion of the filming session,
- the Organizer being granted all necessary rights to use the recorded material, and
- the story being published for the first time as part of the Campaign.
(c) Selected Participants confirm that they own all rights in and to their submitted story, music, performances, and any other materials provided, and that no third-party rights are infringed.
(d) Selected Participants expressly grant the Organizer unrestricted, irrevocable rights to use, reproduce, adapt, edit, publish, and distribute the recorded footage and related Content for the purposes of the Campaign across all Thomann channels, including but not limited to websites, social media, newsletters, advertising, and other promotional formats.
This includes the right to create multiple edited versions, shortened cuts, alternative formats, post-production adaptations, and other derivative works for Campaign-related or other marketing use.
(e) Selected Participants agree not only to participate in an in-person interview, but also to allow audio and video recordings, including filming in their private environment, for storytelling purposes and for the production of B-roll and edited footage to be used in the final Campaign materials.
6. Use of Personal Data and Consent
6.1 Data Processing
By entering the Campaign, participants acknowledge and agree that personal data (such as name, contact details, story content, and submitted images or video) may be collected, stored, and processed by the Organizer for the purposes of administering the Campaign, producing Campaign Content, and fulfilling prizes. Any such processing will be carried out in accordance with applicable data protection laws and Thomann’s privacy policy.
6.2 Rights Grant
Selected Participants expressly grant the Organizer unlimited, irrevocable, worldwide, royalty-free rights and license to record, use, edit, adapt, publish, display, distribute, and otherwise exploit video footage, audio recordings, still photographs, testimonials, story content, and biographical information provided (“Content”), in any media now known or hereafter devised, for promotional, marketing, advertising, commercial, and business purposes, without additional compensation.
This includes the right to create edited versions, alternative cuts, different channel-specific formats, and post-production modifications for Campaign or other related marketing use.
6.3 Public Display
Participants agree that their first name, city/country of residence, and Entry content may be publicly displayed in connection with the Campaign.
6.4 Third-Party Service Providers
For the purpose of Campaign development and implementation (including pre-production, production, and post-production), the Organizer may share participation data with external agencies and the executing film production company supporting the Campaign. Such partners will process personal data only as necessary for these purposes and in accordance with applicable data protection laws and confidentiality obligations.
7. Filming & Event Participation
7.1 Selected Participants agree to cooperate with the Administrator in scheduling and participating in interview filming within the dates communicated.
7.2 Travel arrangements to Thomann headquarters for the interview and voucher collection will be coordinated by the Organizer; travel and accommodation costs may be supported or reimbursed as specified by the Organizer in communications with the Selected Participant.
8. Voucher Conditions
8.1 Thomann vouchers are subject to the terms of use printed on the vouchers and applicable at the time of redemption.
8.2 Vouchers are non-transferable, non-redeemable for cash, and valid only as specified on the voucher. Lost or stolen vouchers will not be replaced.
9. Rights & Responsibilities
9.1 The Organizer’s decisions regarding eligibility, selection of Entries, and all other aspects of the Campaign are final and binding.
9.2 The Organizer reserves the right to disqualify any Entry or participant that it believes violates these terms, is inappropriate, offensive, or otherwise disruptive to the Campaign.
9.3 Participants represent and warrant that their submitted Entry is original, does not infringe third-party rights, and that they have obtained all rights, permissions, and releases necessary for the Organizer to use the Entry and Content as contemplated herein.
10. Limitation of Liability
To the maximum extent permitted by law, the Organizer is not responsible for:
(a) any incorrect or inaccurate information caused by participants or by any of the equipment or programming associated with or utilised in the Campaign;
(b) technical failures of any kind;
(c) unauthorised human intervention in any part of the entry process;
(d) any errors in administration of the Campaign; or
(e) any injury or damage to persons or property relating to or resulting from participation in the Campaign or acceptance, use, or misuse of a prize.
11. Applicable Law & Miscellaneous
11.1 These Terms & Conditions are governed by the laws of the Federal Republic of Germany, excluding conflict of law provisions.
11.2 Legal recourse is excluded to the fullest extent permitted by applicable law.
11.3 Should any clause of these Terms & Conditions be declared invalid or unenforceable, the remaining provisions shall remain in full force and effect.
