Who is the organiser of the competition?

What can you win?

One of 70 Thomann vouchers worth € 70 each.

Who is eligible to participate?

Anyone, including you, can take part if you are interested in Thomann products, our websites, e.g. thomann.de, or our social media sites (including YouTube, TikTok, Facebook, Instagram) and are aged 12 or over.

By participating in the campaign, you agree as a participant to these terms and conditions. Our employees, parent companies or subsidiaries of Thomann and agencies, licensees and their agencies as well as other persons directly involved in the conception and implementation of this campaign are not eligible to participate.

When and how can I participate (entry requirements)?

The campaign begins on 1st April 2024 with the release of the social media campaign and ends on 31st May 2024, 23:59 (GMT). Through the campaign, you will be directed to a landing page where you can register for the Thomann newsletter. Following this, you will receive a confirmation email in which you must confirm your registration by clicking on “Yes, I want to receive the Thomann newsletter!” Once this is done, and your subscription status is not changed by unsubscribing from the Thomann newsletter, you will automatically be entered into the prize draw.

Multiple entries into the campaign are not allowed and will result in disqualification if violated.

In case of a dispute regarding an entry, the rightful owner of the email address provided in the entry form is deemed to be the participant. Potential winners may be required to provide proof to us that they are the rightful owner or lose the claim to the prize.

The participant is responsible for the accuracy of their data, especially their email address.

Entries with invalid or incomplete data, such as non-functional or inactive, or fake email addresses, will be disqualified. As the organiser, we have taken technical measures to exclude fake email addresses in particular from entering the entry form from the very start.

You are not entitled to participate in the promotion.

Your participation in the campaign is free of charge. However, there may be costs for your internet access and usage fees from your internet service provider or other expenses for the registration and execution of the campaign. As a participant, you are responsible for these costs.

When and how do we determine the winners?

The winners will be determined by a random draw. The decision will be made at random. The winners will be drawn at the end of the campaign and notified accordingly. If you are drawn as a winner, we will notify you by email to the email address you provided when you signed up for the newsletter. Voucher prizes cannot be exchanged, are non-transferable, cannot be paid out in cash and no other prizes can be selected as substitutes.

If

a) a winner notification is undeliverable,
b) the winner declines the prize, or
c) a voucher cannot be redeemed for reasons beyond our control,

the respective winner will be disqualified. In this case, we reserve the right to select a new winner through a random drawing among those who have also participated, or the forfeited prize will be raffled again in a new campaign. The winner has 30 days after being notified by Thomann to respond; otherwise, the prize may be transferred to another participant in the raffle.

What additional “fine print” do you need to be aware of?

We reserve the right to end the campaign at any time without prior notice at our own discretion. This possibility exists, especially if, for technical or legal reasons, the proper conduct of the campaign cannot be guaranteed. In this case, we reserve the right to award the prizes to the eligible participants determined up to the time of termination by a random drawing.

We also reserve the right to exclude individuals from participation at our own discretion:

(a) in cases of manipulation related to access to or conduct of the campaign,
(b) for violations of these terms and conditions,
(c) for unfair conduct, or
(d) for false or misleading information in connection with participation in the campaign.

An attempt by a person to interfere with the proper course of the campaign, for example, by using technical means, may constitute a violation of criminal or civil laws. If such an attempt is made by a person, we reserve the right to seek damages through legal action, as well as to revoke and reclaim prizes. The non-enforcement of a provision contained in these official terms and conditions does not constitute a waiver of our compliance with that provision.

Privacy

When you participate in a prize draw, your email address provided in the registration form and questionnaire (if different) will be processed by us for the purpose of conducting the respective prize draw. The legal basis for processing is the fulfillment of the contract or the initiation of a contractual relationship with you as a participant, Art. 6 (1) (b) GDPR.

We have partially outsourced services necessary for the execution and processing of the campaign to third parties (“cooperation partners”). Your data will only be stored by the cooperation partner(s) for the purpose of executing and processing the campaign for the duration of the campaign. All data will be deleted after the completion and processing of the campaign.

We are committed to protecting your privacy and assure you that we process data in accordance with the Federal Data Protection Act (BDSG), the Telecommunications and Telemedia Data Protection Act (TTDSG), and the General Data Protection Regulation (GDPR). In this context, we refer in particular to our data protection information. Here you will also find further information on the exercise of the rights of data subjects to which you are entitled as a participant.

Liability

We shall be released from all obligations upon the fulfillment or transfer of the prize to you as a participant, if any legally binding obligation towards the participant arises at all, depending on the nature of the prize draw.

We shall be liable in the event of malice, intent, or gross negligence in accordance with the statutory provisions. Damages caused by us through simple negligence will only be compensated if it involves a breach of essential duties, the non-compliance with which endangers the purpose of the contract and on whose compliance the participant regularly relies (cardinal duty).

We assume no liability for the insolvency of a cooperation partner, as well as for the consequences arising therefrom for the execution and processing of the campaign. Decisions made by us in all matters related to the respective campaign are final and binding. We reserve the right to correct printing errors or mechanical errors.

Furthermore, we assume no responsibility for lost, damaged, unreadable, incomplete, or late entries, regardless of whether they are due to delays in transportation or incompleteness due to system errors.

We also assume no responsibility for entries not received or not received in full due to force majeure, such as traffic jams, unauthorized third-party interference, malfunctions of computer or telecommunication systems, or incorrect or failed receipt of incoming data transmissions.

Proof of transmission is not considered proof of receipt by us. If you are a winner of a campaign, you are responsible for all applicable taxes, duties, and fees not specified in these terms and conditions.

Miscellaneous

The law of the Federal Republic of Germany applies. In the event that you as a participant are a consumer, this shall only apply insofar as the protection granted by mandatory provisions of the law of the country in which you have your habitual residence is not withdrawn. Should individual provisions of these conditions of participation be or become invalid, this shall not affect the validity of the remaining conditions of participation.
