Who is the organizer of the €70,000 contest?

The €70,000 contest (hereafter referred to as “campaign”) is organized and conducted by:

Who is eligible to participate?

Anyone over the age of 18 is eligible to participate, including you! You must also be registered and subscribed to our newsletter (for detailed participation requirements, see the section “When and how can I participate?”). Minors under the age of 18 are excluded from participation. There will be no prize distribution to minors whose participation is excluded.

Employees of Thomann and its parent or subsidiary companies, agencies, licensees, their agents, and those directly involved in the conception and implementation of this campaign, as well as their family members and household members, are not eligible to participate.

By participating to the campaign, you agree to these terms and conditions as a participant.

 

How does it work?

During the campaign period (see the section “When and how can I participate?”), we will hold seven (7) contest actions and give away high-quality prizes. You can win musical instruments, music equipment from various manufacturers, and Thomann vouchers worth over €70,000. Each contest action is tied to a task that you must solve correctly. We have published the answers to each task on various Thomann platforms (see this section below). The solution may be found on one or more platforms, following the principle “Seek and you shall find.” We can only provide you with the task – a further participation requirement – if you have subscribed to our newsletter and correctly solve and submit the task of the respective contest action (see detailed information in the section “When and how can I participate?”).

When and how can I participate (participation requirements)?

The campaign period begins on 30.09.2024, 2 PM (GMT) and ends on 29.10.2024, 11:59:59 PM (GMT). Starting on 30.09.2024, you can register for the newsletter during a warm-up phase (if not already done); on 07.10.2024, we will launch the first contest according to the timeline. The campaign consists of seven (7) individual contest actions (sub-contests), each with a different period of action, which may overlap in time (see the detailed timeline below).

To participate, you must register no later than 8:00 PM (GMT) on the last day of the sub-contest using a valid email address for the newsletter. Any newsletter registrations received after this time will not be considered for the ongoing sub-contest but will allow you to participate in the upcoming sub-contests.

Example: You want to participate in sub-contest 3 (and any following sub-contests); you must register for the newsletter by 18.10.2024, 8:00 PM (GMT).

In addition, you must submit the correct solution to the sub-contest’s task via the solution form on t.blog (URL) by 11:59 PM (GMT) on the last day of the respective sub-contest.

The email address you enter in the solution form must match the one used to register for the newsletter.

You can participate in every sub-contest. However, multiple entries in one sub-contest are not allowed and will result in disqualification from the respective sub-contest. In other words, only one solution form may be submitted per newsletter subscriber and per sub-contest task.

Timeline and individual contest actions:

 

In the event of a dispute regarding participation, the rightful owner of the email address associated with the newsletter registration will be deemed the participant. Potential winners may be required to provide proof of ownership of the email address or lose their claim to the prize.

You are responsible for the accuracy of your data, particularly your email address. Entries with invalid/incomplete data, such as non-functional or inactive or fake email addresses, will be disqualified. We have taken technical measures to exclude fake email addresses from newsletter registration in advance.

You have no right to participate in the campaign.

Costs may arise for your internet access and usage fees charged by your Internet Service Provider or other expenses incurred during the campaign registration and participation. You bear these costs as the participant.

 

When and how do we select the winners?

A winner will be selected for each sub-contest through a random draw. The random principle applies. Each sub-contest has its own prize pot.

The respective winner will be drawn one day after the sub-contest period ends and notified by email the following day.

If you are selected as a winner, you will be notified via email at the address you provided during newsletter registration and in the solution form. To claim your prize, you must respond to the notification within seven (7) working days (Mon-Sat) from the date of the prize notification email, and provide us with your Thomann customer account number, or create a customer account on thomann.de and provide us with the account number. If you do not respond according to these requirements, unfortunately, you will forfeit your right to the prize. In this case, we reserve the right to select a new winner through another random draw, or the forfeited prize will be re-awarded in a new contest.

Voucher prizes are non-exchangeable, non-transferable, cannot be redeemed for cash, and no other prizes can be selected as a replacement.

Prizes will be shipped free of charge to the postal address provided by the winner, either by us or a third party on our behalf. Any additional costs, such as customs duties, must be paid upfront by you (if applicable); however, you may claim reimbursement from us by submitting the cost receipt. A won voucher will be directly credited to your Thomann customer account.

In case:

the winner will be disqualified. In this case, we reserve the right to select a new winner through another random draw, or the forfeited prize will be re-awarded in a new contest. The right to the prize or compensation for the prize cannot be transferred to a third party.

 

What can you win?

The prizes are listed and described on the contest website, where you can register for the respective contest action. The prize may not necessarily be identical to the products shown. Variations in color, shape, and model are possible.

 

What additional “fine print” should you be aware of?

We reserve the right to terminate the entire campaign or individual contest actions at any time without prior notice, at our discretion. This option is especially available if, for technical or legal reasons, the proper execution of the campaign or individual contest actions cannot be guaranteed. In such cases, we reserve the right to award the prizes to the eligible participants identified up until the time of termination through a random draw.

We also reserve the right, at our discretion, to exclude individuals from participating:

(a) in the case of manipulation related to access to or execution of the campaign or individual contest actions,

(b) in the case of violations of these terms and conditions or applicable legal regulations,

(c) in the case of unfair behavior, or

(d) in the case of false or misleading information provided in connection with participation in the campaign or individual contest actions.

Any attempt by a person to disrupt the proper functioning of the campaign or individual contest actions, for example through technical means, may constitute a violation of criminal or civil laws. Should such an attempt be made, we reserve the right to pursue claims for damages through legal channels, as well as to deny and reclaim any awarded prizes. Failure to enforce any provision of these official rules does not constitute a waiver of our right to enforce that provision.

 

Data protection

If you participate in a contest action, your data provided in the solution form, your email address, and in the event of winning, your address, and if you win a voucher, the email address associated with your Thomann customer account (if different from the one registered for the newsletter), will be processed by us to manage the respective contest action. The legal basis for processing is the performance of the contract or the initiation of a contractual relationship with you as a participant, as per Art. 6 para. 1(b) of the GDPR.

We are committed to protecting your privacy and ensure that data is processed in accordance with the Federal Data Protection Act (BDSG), the Telecommunications and Digital Services Data Protection Act (TDDDG), and the General Data Protection Regulation (GDPR). In particular, we refer to our data protection information. Here, you will also find further information on how to exercise your rights as a participant.

 

Liability

Upon fulfilling or delivering the prize to you as a participant, provided you are drawn as a winner in a contest action, we are released from all obligations, provided that a legally binding obligation arises with you based on the type of contest action.

We are liable in cases of fraud, intent, or gross negligence in accordance with statutory provisions. Damages caused by simple negligence will only be compensated if they involve the violation of a material obligation whose non-compliance endangers the achievement of the contract’s purpose and/or whose fulfillment enables the proper execution of the contest action, and upon which the participant regularly relies (cardinal obligation).

Our decisions regarding all matters related to the contest action are final and binding. We reserve the right to correct typographical or mechanical errors.

We do not take responsibility for lost, damaged, illegible, incomplete, or delayed entries, regardless of whether these are due to transport delays or system errors. Furthermore, we do not accept responsibility for entries that are not fully received due to circumstances beyond our control, such as traffic jams, unauthorized third-party interventions, malfunctions in computer or telecommunication systems, or incorrect or failed data transmissions.

Proof of transmission does not constitute proof of receipt. Should you win a contest action, you are responsible for any applicable taxes, fees, and charges not specified in these terms and conditions.

 

Miscellaneous

The law of the Federal Republic of Germany applies. In the event that you, as a participant, are a consumer, this applies only insofar as the protection provided by mandatory provisions of the law of the state in which you habitually reside is not revoked. If individual provisions of these terms and conditions are or become invalid, the validity of the remaining terms remains unaffected.
